Litigation

Our Litigation team is made up of [token global number-of-dispute-staff-in-words] experienced lawyers who handle litigation, arbitrations and mediations.

Members of the team have been involved in ground breaking cases, in the areas of employment law and banking law and fraud. The team has distinguished itself in the area of banking and finance litigation, commercial litigation, corporate debt recoveries, realization of securities etc.

The team also handles arbitrations, both local and international and some members of the team have distinguished themselves as highly respectable arbitrators.

In its mode of handling disputes, the team focuses on delivering commercially viable results within the peculiar circumstances of each case.

Because of its unrivalled service delivery, the team is respected by both its clients and its peers and regularly receives referrals from international law firms, as well as work alongside international law firms in multi-jurisdictional disputes.

Highlights

Acted on behalf of the Uganda Bankers Association and the 30 (thirty) commercial banks then making up the commercial banking sector in Uganda in a landmark Constitutional Petition against the Uganda Revenue Authority and the Attorney General of Uganda.

Acting for Kinyara Sugar Limited to enforce a tax exemption relating to a USD 18 million investment in Agro-processing plant and machinery. Judgment was delivered in our client’s favour.

Acting for Britt Syndicates Limited – 2987 (Lloyds Underwriters) in a suit involving a claim under an insurance certificate issued by Britt Syndicates Limited arising from the non-appearance of the renowned musician, AKON at a concert. Judgment was delivered in our client’s favour.

Acting for Bank of Uganda and Stanbic Bank seeking the recovery of USD 5 million from guarantors of a company indebted to Stanbic under various facilities assigned to Bank of Uganda.

Acting for Google Uganda Limited in a suit seeking a declaration to the effect that the exclusive supply of marketing and sales support services to Google Ireland Limited was an exported service and is as such zero-rated.

Acting for Aggreko Uganda Limited (a thermal power distributor) contesting a VAT assessment levied it by the Uganda Revenue Authority of Ug. Shs. 145 billion equivalent to USD 58 million. The matter was successfully defended by a Judgment of the 12th September 2012.

Acting for Stanbic Bank Uganda Limited & Jacobsen Uganda Limited in a contempt of Court application in which our client sought to hold the Commissioner General of URA in contempt in relation to enforcement proceedings brought contrary to a protective restraining order. We successfully obtained the Contempt Order and a sizeable fine was levied on the Commissioner General URA.

Acting for Bank of Uganda and Standard Chartered Bank to recover USD 34 million from guarantors of a company indebted to Standard Chartered under various facilities assigned to Bank of Uganda.
